Overview

Based in the British Virgin Islands (BVI), Dan is a partner at MKS Law and a highly-experienced, transnational asset recovery and insolvency lawyer, specialising in complex, cross-border commercial litigation.

Dan brings a wealth of accumulated experience and knowledge to resolving complex, contentious commercial matters, often of a cross-border nature and typically involving a significant element of fraud.

His litigation and trial work has covered a range of international matters for clients from many jurisdictions, including the UK, USA, Brazil, FSU, Hong Kong, PRC, Japan, Nigeria, the Czech Republic and others.

He frequently represents BVI companies in shareholder disputes, striving for quick and cost-effective resolutions for complicated problems. He possesses particular expertise in obtaining offshore disclosure orders and in assisting in 28 USC s.1782 discovery applications in aid of litigation abroad.

He is also well-versed in assisting with the enforcement of arbitral awards, as well as representing clients in unfair prejudice proceedings, fraud claims and trust litigation.

Furthermore, Dan is highly experienced in deploying insolvency remedies as part of a recovery effort and has regularly dealt with crypto asset issues since 2016.

He has run significant litigation in other less frequented Caribbean jurisdictions, including Antigua, St Kitts, St Vincent and the Grenadines, and Montserrat. He particularly enjoys the challenges of complex litigation in these more recondite jurisdictions.

Most recently, Dan has been running a complex receivership over a major development in Barbuda.

Dan trained and practiced in the City of London, before moving to the BVI to join MKS in 2005.

He is a member and a two-term past First Vice President of the BVI Bar Association, a member of the Law Society of England and Wales, and a former British Army officer.

Dan is recommended by both Chambers and Partners and Lexology Index for his work in global asset recovery cases.

Cases

  • Dan has recently been heavily engaged in acting for a Receiver-Manager appointed by the Antiguan court over a very substantial development in Barbuda. This has involved negotiating and documenting a complex multiparty re-financing, as well as related litigation.
  • He continues to act for a longstanding Israeli client who has been subject to significant frauds in Luxembourg and Kazakhstan.
  • In the crypto sphere, Dan has been involved in the successful restructuring of two crypto market-making business caught up in the fall out from the FTX collapse, and in recovery litigation following the fraudulent transfer of significant value in a range of crypto currencies. This work has included freezing orders, service out of the jurisdiction on persons unknown, and connected multi-jurisdictional advice.
